ON THE TERMINATION OF THE AGREEMENT
ON CONFIDENCE- AND SECURITY-BUILDING MEASURES IN
BOSNIA AND HERZEGOVINA
INITIATED PURSUANT TO ARTICLE II OF ANNEX 1B
OF THE GENERAL FRAMEWORK AGREEMENT FOR PEACE
IN BOSNIA AND HERZEGOVINA
Bosnia and Herzegovina, the Federation of Bosnia and Herzegovina and Republika Srpska (the “Parties”),
Acknowledging the role of the Organization for Security and Co-operation in Europe (OSCE) in the implementation of the Agreement on Confidence- and Security-Building Measures (the “Agreement”) associated with Article II of Annex 1B (“Annex 1B”) of the General Framework for Peace in Bosnia and Herzegovina;
Recognizing the successful implementation of the Confidence- and Security-Building Measures;
Conscious of the implementation of the Defense Law that has brought about a single defense establishment in Bosnia and Herzegovina;
Affirming the fundamental role of the Agreement as a factor of security building and stability in the area of application and their adherence to its goals and objectives;
Concluding that changes in circumstances allow for the termination of the Agreement and for the termination of the role of the OSCE CIO’s Personal Representative for Article II;
Conscious of the decision taken by the Council of Ministers of Bosnia and Herzegovina at its session on 16 September, 2004;
Conscious of the decision taken by the government of Republika Srpska on 01 July 2004;
Conscious of the decision taken by the government of the Federation of Bosnia and Herzegovina on 29 July, 2004:
Have agreed as follows:
The Parties agree, in accordance with the provisions of Article V of the Agreement as amended by Annex 3 of the Final Document of the Fifth Review Conference and pursuant to the obligations established by the provisions of Article 78 of the Bosnia and Herzegovina Law on Defense, to termination of the Agreement by the next meeting of the Joint Consultative Commission (28 September 2004), at 2400 hours on 28 September, 2004.
Termination of the Agreement shall not affect any other obligation of any of the Parties arising from the General Framework Agreement for Peace in Bosnia and Herzegovina of December 14, 1995, its annexes, associated agreements, protocols and commitments.
The Parties and the OSCE Chairman-in-Office’s Personal Representative for Article II agree that upon the termination of the Agreement the role and purpose of the Personal representative has been successfully fulfilled and will cease to be necessary.
Termination of the Agreement shall not preclude any of the Parties from agreeing to the voluntary continuation of any measure previously included or associated with the Agreement.
This Document on Termination of the Agreement, drawn up in English and the official languages of the Parties, will be transmitted to the OSCE Chairman-in-Office and to the OSCE Secretariat. This Document will be appended to the Journal of the Joint Consultative Commission. The Parties agree to make this Document available to any OSCE participating State that requests a copy.
Done in Sarajevo, 28 September 2004, in the English language. Authentic translations of this Document will be prepared by the office of the Personal Representative in the official languages of the Parties.
